This work aims to propose a reflection about the extent of the devolutive effect regarding to extraordinary appeals. It question about the interference threshold of judgment of admissibility, especially relating to “prequestionamento” (one of the admissibility requirement), regarding to the subject that will be return to the Superior Court of Justice and the Supreme Court for analysis, since they are an extraordinary instance, without the pretension of exhausting the subject. To this end, examines, first, the object of the procedural system resources. Then, it passes to the specific examination of extraordinary appeals from its historical origin, purpose until the admissibility requirements. After, deals with the function of the Superior Courts in Brazilian Procedural Civil Law, making the distinction between Court of Cassation and Reviewer Court and between the judgment of admissibility and judgment of merit. It also makes a critical analysis about decisions already rendered by the Supreme Court regarding to the judgment of admissibility of the appeal non-binding for the judgment of merit. Deals with the prediction of the draft of the new code of civil procedure concerning the matter. Finally, presents the conclusion regarding to the extension of the devolutive effect of extraordinary appeals
