The collective process has brought the figure of the homogeneous individual rights to the brazilian ordainment, becoming one of the main mechanisms to solve the similar individual conflicts. Though the defense is a individual right, it is important that the user of the law has in mind that collective processual microsystem is reigned mainly by the Law of Public Civil Action and general regime of collective process of CDC, differentiating in several aspects of the individual lawsuit applied conform the CPC. This distinction is fundamental, principally, about the formation of the executive title. In the face of the norm contained in art. 95 of CDC, in the cases of success of the collective actions of homogeneous individual interests, the condemnation will be generic, determining only the defendant’s responsibility about the caused damages. Only with these elements isn’t possible to apply mandamental effects to the executive title, because still needs a complete cognition and ample contradictory about the existence of the recognized right in the collective action, the creditor’s ownership, the individualization and o amount of the debt. The subject matter of the present work is exactly the inapplicability of mandamental effects in collective process of homogeneous individual interests..
