Resumo: This paper discusses the Repetitive Claims Resolution Incident, instituted by Law No. 13.105 / 2015 in force since 18 and March 2016, which is provided for in Articles 976 to 987 of the Civil Procedure Code, which aims to reduce the jurisprudential dispersion. , imposing on the courts the obligation to standardize the jurisprudence on determining subject discussed in repetitive causes with the same controversy of law, as the situation reveals risk of violation of equality and legal certainty of decisions. Once the incident is admitted, the processing of the other identical cases will be suspended, and after, after unrestricted publicity, the merit of the incident will be judged, at which point the legal theses of binding effectiveness will be created on the question, aiming at the appeasement and standardization of case law. In addition to the conceptual core issues, controversial points will be examined that has generated debate in doctrine and jurisprudence, especially the constitutionality of the institute in light of the theory of tripartition of powers

Admitido o incidente, a tramitação dos demais processos idênticos será suspensa, e, posteriormente, após irrestrita publicidade, será proferido o julgamento do mérito do incidente, momento em que serão criadas as teses jurídicas de eficácia vinculante sobre a questão posta a julgamento, visando o apaziguamento e uniformização da jurisprudência.
