The family property, originally approached by the legislator with a view to preserving the family entity, with a view to guaranteeing the constitutional right to housing, is conferred by Law 8,009 of March 29, 1990 and is based on making the residence that serves as a property unaffordable to the family. However, the same law that protects, also gives exceptions, and, just about one of these exceptions, this study is based, that is, the possibility of pledging the guarantor's family property, due from a guarantee granted in a lease, thus establishing , many judicial controversies, some of the main ones, will be approached in this study, especially in the field of civil litigation, evaluating the main judicial decisions on the subject, as well as the respective maturation, divergence and modification of these decisions over time
