The present study is to analyze the security magic of the family heirloom of the guarantor of the lease within a constitutional perspective and its impact in the legal field. We can confront the various positions on the subject in order to achieve the best exegesis, i.e., one that meets the aspirations of society. The lease has great influence and impact on different aspects of society. This agreement is a source of various debates and studies of the most renowned jurists in the country, even deserving of a special law. An issue that deserves particular attention within the theme concerning the security of the leasing right of guarantor's family given as guarantee in the leasing contract. This matter involves the highest caste rights such as the right to housing and the right to freedom of contract and therefore the theme real estate leasing offers the same complexities of these two major problems of the current society. These themes are closely linked so as to interact and influence each other. It is known that any imbalance or dysfunction in this legal relationship may result in consequences in other vital areas to the public, in particular on the right to housing
