Resumo: This dissertation has as its object the “legal institution of the counterclaim”, according to the specific discipline brought by the current Code of Civil Procedure (Law n. 13.105/15), in the provisions of its article 343, caput and §§ 1 to 6. It situates its introduction and continuity in the Brazilian Legal System, in a brief history; points out its current legal discipline in the Code of Civil Procedure and sparse legislation. Discusses the concept and legal nature of the counterclaim and the respective counterclaim action, its requirements and procedures, from filing to final compliance. Emphasis is given to the main legislative innovations, especially regarding the legitimacy of third parties and the form of the initial counterclaim. Finally, in different chapters, the distinction of the counterclaim with similar institutions and the possibility of third-party intervention in the counterclaim action is discussed

Situa sua introdução e continuidade no Ordenamento Jurídico Brasileiro, em um breve histórico; aponta sua atual disciplina legal no Código de Processo Civil e legislação esparsa. Discorre sobre o conceito e natureza jurídica da reconvenção e da respectiva ação reconvencional, sobre os requisitos e procedimentos desta, da propositura até final cumprimento. Dá-se ênfase às principais inovações legislativas, em especial quanto à legitimidade de terceiros e à forma da inicial da ação reconvencional.
