The present study focuses on understanding the collective judicial stoppel and determines its limits. It starts with a cursory analysis, but essential, of individual judicial stoppel, and then to investigate the institute in the collective sphere, without forgetting the historical context. The objective limits and especially the subjective ones of collective judicial stoppel are explored, opening the study to the legal regime of judicial stoppel in the many facets of the transindividual guardianship. The collective effect of judicial stoppel at the individual gained ground also in the demarcation of the limits of collective judicial stoppel. The great controversy of the territorial limitation of the effects of collective decision recently won a new chapter. From the trial we will make an important digression on the major debates on the subject
