The subject of this research is “The Usufruct of Shares of Companies in Brazilian Law”. Its objective is to examine the institute in the light of doctrine and jurisprudence on the concept and evolution of usufruct, including in the light of the historical process, as well as its application to the shares issued by brazilian corporations. Along this path, the modalities of usufruct, its regime, its form of constitution and its extinction mode will be studied. On the other hand, corporations, the concept of action, their modalities and their nature, as well as the essential traits that may be useful in the use of usufruct, will be briefly examined. That said, it will be discussed about the form of constitution of the usufruct of shares, the legal regime provided for them in the current law and the problems arising, either from the application of one or another rule, or due to the potential or actual conflict between the owner of the shares. shares and usufructuary in the light of the rules and duties, known to be complex, instituted for the corporation
