This paper discusses the Clean Development Mechanism (CDM) and Certified Emission Reductions (CERs) - also called carbon credits - derived from the Kyoto Protocol in 1997. The aim will be to examine the application and operation of such CDM projects in Brazil, and what the results achieved from the perspective of sustainable development. The research will take place in the possibility of developing countries, such as Brazil, create investment opportunities in the implementation process of the CDM through the issuance and trading of CERs. Based on surveys and reports developed by the Intergovernmental Panel on Climate Change (IPCC), environmental, social and economic consequences of global climate change will be pointed out. Moreover, since the carbon market, created by the Kyoto Protocol, is formed from the set of business operations with CERs - carbon credits - will be addressed, too, the current world situation combat the issue of causing the gases greenhouse. For best theme approach will be outlined the role of international and national legal instruments on climate change, with reference to the United Nations Conference on the Human Environment (1972); the United Nations Conference on the Human Environment and Development (1992); to the United Nations Framework Convention on Climate Change (1992); to the Kyoto Protocol (1997); the Marrakech Accords (2001); for constitutional and infra bases governing the matter in Brazil, culminating in the establishment of the legal framework of the medium climatic environment. With such theoretical basis, the analysis of the Brazilian contribution to averting climate change and the main legal instruments of defense of the climatic environment is essential, emphasizing the participation of civil society, the public prosecutor and non-governmental entities
