This monograph reviews, based on the guidelines established by the Constitution of the Republic, the legislative competence of the municipalities to handle the subject of solid waste. It examines the case study of the São Paulo municipality, where around 20.000 tons of waste are produced daily, talking about the Municipal Law no 13.316 dated February 1st, 2002. This law aimed at protecting and safeguarding the life quality of the population, provides on the collection, final destination and re-use of solid waste, in an authentic reverse logistics network. This monography concludes that the municipal competence handles the topic of solid waste regarding the competence of the Municipalities to legislate about topics of local interests and the environment, as well as for the full compatibility of the Law no 13.316/02 of the São Paulo municipality with the federal legislation about the theme – the Federal Law no 12.305/10, that instituted the Solid Waste National Policy and has brought general rules on the subject
