This work aims to analyse the incidence of prescription on the periodic fine or the one resulting from the breach of conduct adjustement agreements (TAC) signed with the Public Ministry. The study covers the concept and the nature of the commitment to conduct adjustment, the typical content of the TAC: obligation to do and not to do, obligation to give, inhibitory tutelage, the deadline for compliance na to pay fine in case of non-compliance. Specifically about the effect the prescription, this study examines which contents are subject to prescription, total prescription and parcial, the limitation periods and the grounds for suspension and interruption of prescription. Below we analyse a concrete situation, which occurred under the Public Ministry of Labor and, at the end, the conclusions are presented: covers prescription at fine resulting from breach of conduct adjustment of commitment; the prescription is total or partial, according to the nature of the fine (periodic or single); the limitation period is five years, for obligations to do, the initial termo of the limitation period is the date of signing of the TAC or the end of the prescribed period, if any; for obligations not to do, the initial term of the prescription is the date of the prohibited act practice
