Resumo: In this study we will make an overview about tax planning. We begin instituting assumptions underlying understanding of the subject inserted into the Brazilian legal system, treating language as a constitutive element of the legal reality in respect to all that teaches us the constructivist current, and emphasizing the necessity to respect the fundamental principles and rights brought by Constitution of the Federative Republic of Brazil. We will bring an analysis of the business purpose in the Brazilian context, and finally, we will discuss this unlawfulness in evasion, which entails the permissibility elision, and analisares Article 116 of the National Tax Code
