The modern world and the velocity due to the new technologies, especially information technology, has reduced the distance between people. The use of this technology in the workplace, particularly for the professional e-mail, facilitates internal and external communications, but also brings some questions about the proper use by the employee and the possibility of control by the employer. We will cover topics such as the constitutional principles involved, the collision of constitutional rights guaranteed to employees and the employer, the powers of the employer, employee rights, statistics on the use of corporate email, forms of surveillance email adopted by the employer and placement of the Superior Court of the works on the subject. Try to demonstrate that it is possible the coexistence of constitutional rights that appear antagonistic, in compliance with their proportions.
