Resolution nº 510/16 of the National Health Council (Conselho Nacional da Saúde) provides the ethical rules that are applied to research in the area of Human and Social Sciences whose methodology provides for the use of human beings, as well as the use of personal information that may be identified by the participants, causing them some sort of harm. The present thesis aims to, thus, discuss the pertinence of psychoanalytical case study research on the basis of the guidelines of said resolution. What motivated us to develop this work was the contact we had, at the time of development of the master’s thesis, with the Ethics and Research Committee (Comitê de Ética e Pesquisa) present at the University, to which one has to submit any project that utilizes data from human beings. It is intended to discuss here whether the data utilized in psychoanalytical case study research fits the profile established by resolution 510/16 or if this type of research is among those that will not be registered or evaluated by the CEP/CONEP system. From there on, changes will be proposed to this resolution and its corollary, the Brazil Platform (Plataforma Brasil). The need to seek consent or not from the patient whose data will be used to prepare an investigation is the central argument of this study, which also aims to set a scenario for what should be its ethics, as well as its science
