This monograph studies a damage called by existential damage and their application in the labor law. The existential damage is not inside the brazilian law, because of that, it’s necessary to do an analysis of liability, and about damages found until now, under the Federal Constitution of 1988, which have as fundamental principle the human dignity. Therefore, the Existential Damage is a damage that takes the personal rights, protected by the Federal Constitution too, such is linked to the human dignity, so it’s necessary an analysis of two essential aspects: the damage of life relationships and the damage of life’s project, that reach directly the life’s quality. Inside this context there’s no way how to exclude the workers, who suffer with a long labor journey or suffer by some damage to their health, and by mobbing, that force them to a new life style, injuring their social and familial relationships, frustrating their future expectatives
