Resumo: This paper aims to present a complete study of the contracts shopping center, always on the legal perspective. So, first we will outline the context and emergence of these establishments, with concepts and definitions, a historical view and the different modalities, in addition to its legal nature. After these introductory concepts, develop study by analyzing the applicable law, verifying the applicability of the Code of Consumer Rights and the bills in progress , as well as comparisons with other countries of the legislation . Next, we will work the contract characteristics, highlighting the parties involved and the related instruments, as well as the controversial clauses and the peculiar aspects of leases in shopping centers. Finally, we discuss the position of the judiciary, analyzing appropriate legal actions , civil liability and the relevant case law in this matter

Assim, primeiramente destacaremos o contexto e o surgimento desses estabelecimentos, apresentando conceitos e definições, uma visão histórica e as diversas modalidades, além de sua natureza jurídica. Após esses conceitos introdutórios, desenvolveremos o estudo através da análise da legislação aplicável, verificando a questão da aplicabilidade do Código de Defesa do Consumidor e os projetos de lei em andamento, além da comparação da legislação com outros países. A seguir, iremos trabalhar as características do contrato, destacando as partes envolvidas e os instrumentos relacionados, assim como as cláusulas polêmicas e os aspectos peculiares dos contratos de locação em shopping centers.
