Resumo: Driven by the considerable increase in the diagnosis of cancer in young adults entering the labor market, the present study aims to raise the legal bases that prevent the discriminatory dismissal of workers with malignant neoplasia. Based on the social function of the company, which derives from the social function of contract and property, as well as the social value of work and the work environment, the dismissal of workers with malignant neoplasm is considered discriminatory, according to the understanding of Superior Labor Court, consequently generating the right to reintegration of these workers
