Introduction: This paper seeks to analyze the socioeducational measures applied to juvenile offenders with mental illnesses in detriment of the application of the security measure. Objective: To develop the concept and application of the institute of security measure in the current Brazilian penal legislation, as well as, on the other hand, the socioeducational measure applied to underage offenders. Materials and Methods: It was used the analysis of studies published by relevant Councils, such as the Federal Council of Psychology and the Federal Council of the Brazilian Bar Association (OAB). Information from the National Association of Public Prosecutors in Defense of Health and works by several authors was also used, as well as reports. Results: The real legal gap caused by the lack of effective legislation in the treatment of juvenile offenders with mental illness was affirmed. Discussion: Both the state power and society should be better prepared to deal with the group in question
