Resumo: | We will begin the construction of the present work under the focus of Democratic State of Law. In this first chapter we will be devoted to the appearance of the Law as a science and we will broach the difference between Judgement and Law. The second chapter has been reserved to the institute of citation - that consecrates the contradictory and general defense - having in view that is not associable his/her apprehension to the study of Default. Beginning from the citation's concept and telling his procedural effects. Already in the third chapter, we looked for in Alien Doctrine, the study of Default, comparing it with the Spanish, French, Italian anda German Law. A prominence was given to the fourth chapter, where we treated of several theories about legal nature of Default's institute. In spite of the previous chapter have approached about Default's theories, we searched her concept and we brought a brief historical sketch as much about Roman Law how much about Brazilian Law. In the last chapter, we approach about Default in Penal Suit, which is the principal topic of this work. Finally, we will try share the presence ofthe Contradictory and General Defense - constitutional principles guaranteed on his own Legal Process - applying the Default's concept under the approach of Process' form |

Neste primeiro capítulo nos dedicaremos ao surgimento do Direito enquanto ciência e abordaremos a distinção entre Juízo e Lei. O segundo capítulo foi reservado ao instituto da citação – que consagra o contraditório e a ampla defesa – tendo em vista que indissociável sua apreensão ao estudo da Revelia. Partindo do conceito de citação e narrando seus efeitos processuais. Já no terceiro capítulo, buscamos na Doutrina alienígena, o estudo da Revelia, comparando-o com o Direito Espanhol, Francês, Italiano e Alemão. Destaque se deu ao capítulo quarto, onde tratamos das diversas teorias sobre a natureza jurídica do instituto da Revelia. Não obstante o capítulo anterior ter abordado sobre as teorias da Revelia, buscamos o seu conceito e trouxemos um breve esboço histórico tanto no Direito Romano como no Direito Brasileiro. No último capítulo, abordamos sobre a Revelia no Processo Penal, tema principal deste trabalho.
