The Brazilian Supreme Court (STF) judges the Extraordinary Appeal (RE) 1.017.365, whichdiscusses a request for repossession filed by the Santa Catarina Environment Institute (IMA)against the National Indian Foundation (Funai) and the Xokleng, indigenous peoples from theIbirama-Laklãnõ territory. The State of Santa Catarina claims part of the territory traditionallyoccupied by indigenous people. In 2019, the Supreme Court plenary recognized the generalrepercussion of the RE judgment, which discusses the thesis of the “temporal framework ofoccupation”. This thesis intends to set the date of October 5, 1988, the day of thepromulgation of the Federal Constitution, as a milestone for the examination of theoccupation of indigenous lands for demarcation purposes. This means that indigenouspeoples would only have the right to demarcate lands that were either in their possession orunder proven physical or judicial dispute on October 5, 1988. Therefore, this work seeks todiscuss, through a bibliographic review, whether this thesis respects the fundamental rightsconstitutionally guaranteed to indigenous peoples in Brazil
