This paper aims to explore the current legal scenario to which the Smart Contract technological tool powered by Blockchain is subject in Brazil, with an analysis of its structure and legal treatment, especially from the standpoint of civil and commercial law. The justification for this work lies in the need to inspect this new electronic contractual modality and its insertion in the legal system, since the adaptation of the Brazilian regulatory system is often outdated in the face of technological innovations, especially those that have, simultaneously, a high potential for evolution and level of complexity. In this sense, a study about the subjection and applicability of the Smart Contract tool, as well as the distribution and dimension of risks between the parties involved inherent in contractual relations, is necessary for the benefit of the current legal system and for this thesis to serve as a basis for future studies
