Resumo: Environmental policies have been pointed out in legal field, in way of improving this area, according to the Brazilian Federal Constitution and the Law of Environmental Crimes, nº 9.605/98, which assure punishment responsibility of corporated body by practicing aggressive contact with environment milieu. It means a conflict among a special part of society who have a real comprehension of the law. Since that, some of then agree with punishment, and other do not take it into the consideration, as a standard. For these reasons, this article analyses the way of defending and protecting the environment milieu related to punishment
