The purpose of this study is to analyze the cause of action and the application of the latin expression iura novit curia in the lawsuits that are based on civil liability. Therefore, it is interesting to approach the monopoly of the exercise by the Court Judge, as well as on certain constitutional principles that ensure to the citizens that the lawsuit is not only a way to obtain a judicial remedy able to resolve the dispute, but also an ethical, moral, social and political instrument of justice and freedom. We also wrote about the specificities of the cause of action. The relevant aspects of the civil liability were also a subject of this study. Finally, we studied the iura novit curia rule and the possibility of modification of its legal grounding without violating the principle of the due process of law
