This study intends to analyze the exercise of directive power of the employer in the intimate inspection and inspection of personal belongings of employees as a way of protecting his activity /property, and the concomitant effectiveness of the fundamental rights of the worker. It is true that the employer has a constitutional right to protect his property which gives support to his directive power/right, on the other hand, the constitutional law provides for the immediate effectiveness of fundamental rights, rights of personality in private relations, particularly in work relation. Thus, this study seeks to examine the possibility of intimate search or inspection of personal belongings of employees. It is questioned whether it is possible to exercise the directive power/right, the limits of the employer and the effectiveness of fundamental rights involved. It is intended to analyze this conflict through the study of the assumptions of constitutional law, fundamental rights theory, doctrine and jurisprudence of the main labor courts.
