Resumo: The purpose of this work consists of pointing out the relevance of the cruises in Brazil and the importance of the cautious analysis regarding the competent jurisdiction applicable to the labor relationship established on the vessel that has globalized characteristics. Some cases law suits will be analyzed concerning the ―Ship’s flag theory‖, which has as its basic premises that the vessel is an extension of its flag’s domain, therefore, attracting the jurisdiction of the corresponding country. On the other hand, the ―favor flag theory‖ will be taken into consideration, which refers to the hypothesis in which the flag supported by the vessel is simply fictitious, in order to defraud rights. Finally, practical difficulties will be approached in which the understanding likely to the Brazilian law application would bring on the routine of the cruise which hosts crew of several nationalities

Serão analisadas as tendências jurisprudenciais no que diz respeito à aplicação da teoria do pavilhão, que tem como premissa básica o fato do ser navio a extensão do território da bandeira que sustenta, atraindo, portanto, a jurisdição do respectivo país. Por outro lado, será ponderada a teoria da bandeira de favor, que trata da hipótese em que a bandeira sustentada pela embarcação é meramente fictícia, especialmente com a finalidade de fraudar direitos.
