Resumo: Bitcoin is an intangible medium of exchange that emerged in 2009 and has given rise to relevant debates on the legal nature of cryptocurrencies and the taxation that should be levied on them. This paper aims, in the initial chapters, to map the possible legal natures of Bitcoin, in the light of the historical concept of currency and the legal concepts of security, credit instrument and financial assets. In the final chapters, the materiality of ICMS is explored, as well as the possibility that this tax affects the purchase and sale and import of cryptocurrency, based on doctrinal positions and determinations of official authorities
