The aim of this work is related to present the evolution of women’s struggle to be considered equal regarding men in their rights and guarantees. In spite of the full national and international legislation that deals with this subject, including laws that ratify the same women’s guarantees assigned to men, it is verified that, in the real life, women, always is treated in a different way; at work: getting smaller wages than men; in religion: not entering into religious temples; in school: not having the same rights of education as men, etc. To demonstrate everything that were said above, I will explore the Brazilian and foreign doctrine specialized in this matter. In addition, It will be mentioned some jurisprudences of Brazil and Worldwide. Finally, I will present the theme in a vision of the Brazilian and international media. So, although, women's rights have improved a lot in the world, especially in Brazil with the promulgation of the Federal Constitution, with respect, mostly, title 2 “Individual Rights and Guarantees”, we realized that it was not enough. Therefore, it is essential to create mechanisms, which are called “affirmative action”, that can help to minimize this disparity. Even though with all the struggle and despite of the creation of many positive public practices, it can not be said that women stand at the same level as men, in rights and guaranties. Thus, the present study aims, even, to expose the current stage of women’s rights in Brazil and in the world
