The present work aims to study the ways of structuring the legal arguments that are developed to justify the application of norms establishing basic constitutional rights, in order to show the possibility of employing such techniques in private relations. For this purpose, it will proceed by a preliminary and comparative analysis of legal norms in general and norms containing fundamental rights, identifying the conceptual and structural characteristics of these categories, so that the particularities involved in the application of the second class of norms can be circumscribed. This procedure allows to show the different manners by which one can construct arguments using the norms that establish basic constitutional rights as premises, what, in turn, helps to identify and isolate the main troubles involved in the use of such argument forms in private law. The main hypothesis defended in this work is that the arguments that apply legal norms containing basic constitutional rights in private relations are not structured uniformly for all norms and situations, because there are general aspects that must be taken into account and that influence the construction of the argument both formally and substantially. Due consideration to such general variables, and the employ of the proper forms and contents in the argument to each combination of them, is what enables the development of a consistent argument applying constitutional rights in the sphere of private law
