Resumo: The corporate criminal liability is a recent instrument of protection created seeking to give a more energetic response to a new criminality that was being formed, characterized by the involvement of companies in criminal practice. The approximation of the company with crime in the 20th century fostered the debate about its responsibility and the creation of means that could adequately rebuke it, given its particular nature. The solution adopted was the criminal liability of legal entities. Currently, the institute is widely adopted by several nations, among them Brazil, which established its liability model through Law no. 9.605/98, restricting its incidence to environmental crimes. However, since its conception, this means of imputation has been facing strong resistance by the doctrine, which sustains its unconstitutionality. This doctrinal reluctance results in a scarcity of studies on the subject, which perpetuates the problems of the first Brazilian test, Law 9.605/98. Several other nations, in which the debate is more advanced, have managed to achieve solutions to their initial obstacles, sometimes even moving away from the criminal area. It is necessary to make use of foreign solutions and encourage national debate on the subject in order to seek alternatives and give effectiveness to the means of curbing modern criminality

A aproximação da empresa com o crime no século XX fomentou o debate acerca da responsabilidade da pessoa coletiva e da criação de meios que pudessem repreendê-la adequadamente, dada a sua natureza particular. A solução adotada foi a responsabilização criminal dos entes morais. Atualmente, o instituto é largamente adotado por diversas nações, dentre elas o Brasil, que estabeleceu seu modelo de responsabilização por meio da Lei n. 9.605/98, restringindo a sua incidência aos crimes ambientais. Entretanto, desde a sua concepção, este meio de imputação sofre grande resistência por parte da doutrina, que sustenta a sua inconstitucionalidade. Esta relutância doutrinaria resulta em uma escassez de estudos sobre o tema o que faz com que os problemas do primeiro ensaio brasileiro, Lei n. 9.605/98, se perpetuam. Diversas outras nações, nas quais o debate se encontra mais avançado, conseguiram alcançar respostas aos seus entraves iniciais, por vezes, inclusive afastando-se da esfera penal.
