Os princípios da independência e imparcialidade e o dever de revelação dos árbitros: uma análise da prática nacional e internacional de aplicação dos institutos

The present work aims to analyze the institutes that support arbitration practice: the duties of arbitrators to act with impartiality and independence, as well as the extent of the duty to disclose facts that may raise justifiable doubts in the parties regarding the duties of the arbitrator appointed to judge the controversy in which they are involved. The intention is, first, to analyze aspects of the figure of the arbitrator and then to describe the institutes of independence and impartiality and the duty of disclosure, as well as to point out related principles, such as the principle of trust. Once such concepts are defined, it will be appreciated the provisions of the Brazilian Arbitration Law (Law 9.307/96), the UNCITRAL Model Law, the arbitration chambers' regulations and, mainly, the International Bar Association - IBA guidelines on Conflicts of Interest in International Arbitration, which, although not enforceable, do provide standards to evaluate the impartiality and independence of arbitrators, as well as to determine in which contexts the duty of disclosure should be exercised. Finally, practical cases on the central theme of this paper will be analyzed
