With the advent of Law 11,101 of 2005, the legal reorganization institute appears in our legal system. The evolution of the institute became necessary, since previous legislation was completely inadequate in the face of social and economic cultural development. With the new Law, the general meeting of creditors, a collegiate body with the function of deliberating on the recovery plan presented by the debtor in crisis, is created. Such determination is given by the exercise of the right to vote. This paper addresses the abuse of voting rights at the general meeting of creditors, which decides on the plan presented by the debtor in the context of judicial recovery. Despite this, the Business Recovery Act does not establish criteria regarding abuse of the right to vote. It focuses on the importance of the subject in order to analyze first the abuse of law in the Civil Code and its conciliation with the principles that guide the judicial recovery institute. The discussion takes place based on a critical analysis in the jurisprudential and doctrinal aspects on the subject in question
