The present work carries out exploratory research, conducted from a bibliographical perspective, on the judicial decision-making paths taken by the STF in the field of the right to health, in order to verify how the SUS has been configured. Deliberations are the object of study, with general repercussions. For this analysis, we present a reading about the pandemic moment experienced by the entire Brazilian and world population, with emphasis on the performance of the SUS in Brazil. The thesis is defended that the decision-making route as a general repercussion in the STF, when analyzing the health/SUS theme, is little expressed or aims to rescue the format of the constitutional SUS. To understand the right to health, the SUS is urged to position itself as a public system in the midst of the opposition it faces and which are materialized in the field of general repercussions, as configured by the STF as its institutional image. It was noted that the SUS has sought to fulfill its function even in the face of high demands, scarce resources, underfunding and attacks so that this system can be dismantled. It was observed that the STF has an image of a timid SUS, insufficient in resources and that the cause is due to the increase in people, but without analyzing that it is poorly cared for by the public authorities themselves and by the society that has not yet welcomed it
