This study begins with the fundamental rights of trade union freedom, to identify by historical analysis of the evolution of sindicalism, as a compensatory instrument of socio-economic inequality that workers are subject to and as mechanism for dialogue and interaction between the union agents within a capitalist society. Then, the dimensions of trade union freedom are addressed, its functions and responsabilities within the collective legal relations and the issue of bilateralism of this institute with respect of who holds their ownership. Continuing, this work analyzes the trade union freedom in the face of constitutional antinomies and fully explores limitations of this fundamental freedom. Finally, develops a critical view of the principle of trade union freedom, highlighting the importance of their integration and applicability within a context guided by social progress
