Resumo: This study aimed at assessing whether the legal provisions set forth in the Brazilian Civil Code make parents or legal guardians responsible for damages caused by their underage children and in which situation there may be exceptions. The research investigated the legal provisions in Brazil that make parents or legal guardians liable for damages caused by their underage children and any exceptions thereof. The methodology used in the research consisted of bibliographical research, based on the wide range of sources that are available in periodicals, articles on the internet, in the Brazilian legislation and jurisprudence, among others that can bring information and reflections on the subject. As a result, it was possible to conclude that in such relationship of responsibility involving parents and children, the theory of risk prevails, which better fits the interests of Justice and protection of the dignity of the person, in this case, the victim, considering that there will be solidarity between the minor child and the father or mother regarding reparation of the unlawful act. Therefore, the minor's assets will be liable for reparation, that is, for the consequences of the serious act committed against a third party

O problema investigado foi: Quais os dispositivos legais no Brasil que responsabilizam os pais ou responsáveis legais pelos danos causados por seus filhos menores de idade e se há alguma exceção. A metodologia utilizada na pesquisa consistiu de pesquisa bibliográfica, fundamentada no amplo leque de fontes que se encontra disponível em periódicos, em artigos da internet, na legislação e jurisprudência pátria, entre outros que possam trazer informações e reflexões sobre o assunto. Com o resultado, foi possível concluir que nessa relação de responsabilidade que envolve pais e filhos predomina a teoria do risco, a qual se enquadra melhor nos interesses de Justiça e na proteção da dignidade da pessoa, no caso, a vítima, considerando-se que haverá solidariedade entre o filho menor e o pai ou mãe com relação à reparação do ato ilícito.
