The present work explores the doctrinal legal positions of the contravene theory that involves the transferable effect of admissibility in the exceptional appeal, the High Superior Court in Brazil is taking the new tendency and put into practice, of course, with some particularities. Despite of all the classical doctrinal legal opinion, in the past years an increasing numbers of followers are positive in the application of this effect into the exceptional appeal, whose the legal basis will be explained in the body of this study. In summary, the major problem for the legal counselors are the rules of the Federal Constitution articles 102 and 105, which they dispose about admissibility requirement in the extraordinary review and appeal to the Federal Superior Court, respectively, especially when we use the term “ determined cause” . During this study we discourse about the term “application of the right for the indexation” which this is explained in the statement of this abridgment of law 456 of the Respectable Supreme Court and its reach front to the treated subject. As a result, from the decision pronounced for the Superior Tribunal of Justice and of these doctrinal position and its respective legal basements, we will survey, without the pretension to deplete the quarrel, the position that more combine with our Brazilian recourse system
