Resumo: Judicial recovery is a legal mechanism designed to help companies facing financial difficulties to restructure their debts and restore their economic health. This process is especially relevant for micro and small businesses, due to their importance in the economy and the role they play in job creation and local growth. Micro and small businesses are often subject to volatile economic conditions, fierce competition and other adversities that can lead to financial problems. Judicial recovery offers these companies the opportunity to avoid bankruptcy and seek alternatives to reorganize their finances, allowing them to continue operating and contributing to the economy. In Brazil, Complementary Law nº 123/2006, also known as the National Simple Law, brings specific provisions for the judicial recovery of micro and small companies. It provides for differentiated treatment for these companies in the judicial recovery process, in order to make the procedure more agile and less costly. Judicial recovery for micro and small businesses involves the presentation of a recovery plan, in which the company describes the measures it intends to adopt to overcome its financial difficulties. This plan must be approved by the creditors and ratified by the judge responsible for the case. During the recovery process, the company gains a grace period to settle its debts and reorganize its activities. The present study aims to identify the judicial recovery for micro and small companies in Brazil. The methodology used for the elaboration of the study is qualitative research, through a bibliographic review. It is concluded that judicial recovery is a legal tool that allows micro and small companies to face financial difficulties in a structured way and, ideally, to resume their activities in a sustainable way. This contributes to preserving jobs, strengthening the local economy and promoting entrepreneurship

Esse processo é especialmente relevante para microempresas e empresas de pequeno porte, devido à sua importância na economia e ao papel que desempenham na geração de empregos e no crescimento local. As microempresas e empresas de pequeno porte, muitas vezes, estão sujeitas a condições econômicas voláteis, concorrência acirrada e outras adversidades que podem levar a problemas financeiros. A recuperação judicial oferece a essas empresas a oportunidade de evitar a falência e buscar alternativas para a reorganização de suas finanças, permitindo que continuem operando e contribuindo para a economia. No Brasil, a Lei Complementar nº 123/2006, também conhecida como Lei do Simples Nacional, traz disposições específicas para a recuperação judicial de microempresas e empresas de pequeno porte. Ela prevê um tratamento diferenciado para essas empresas no processo de recuperação judicial, a fim de tornar o procedimento mais ágil e menos oneroso. A recuperação judicial para microempresas e empresas de pequeno porte envolve a apresentação de um plano de recuperação, no qual a empresa descreve as medidas que pretende adotar para superar suas dificuldades financeiras. Esse plano deve ser aprovado pelos credores e homologado pelo juiz responsável pelo processo. Durante o processo de recuperação, a empresa ganha um período de carência para quitar suas dívidas e reorganizar suas atividades. O presente estudo tem como objetivo identificar a recuperação judicial para micro e pequenas empresas no Brasil. A metodologia utilizada para a elaboração do estudo se trata de uma pesquisa qualitativa, por meio de uma revisão bibliográfica. Conclui-se que a recuperação judicial é uma ferramenta legal que permite às microempresas e empresas de pequeno porte enfrentar dificuldades financeiras de maneira estruturada e, idealmente, retomar suas atividades de forma sustentável.
