Resumo: Objectives: To explain the labor discrimination faced by Brazilian women; Analyze the current labor laws that deal with the matter; Analyze possible changes in labor law that bring help to the insertion of women in the labor market. Rationale: Based on the history of the work of women and the aid of comparative law, the present brings in its scope some of the difficulties faced by women in family and work daily life and is focused on the achievement and effectiveness of equity in labor relations. Hypotheses: Over the years, women have encountered several barriers in the labor market, both regarding their insertion and their ascension. What is the reason for this reality? What factors contribute to women's difficulty in entering the labor market? Theoretical-methodological aspects: Analysis of the Brazilian Legal Order, from the understanding of labor law scholars, Jurisprudence and academic publications. Results obtained: Research on women's work reflects a scenario that unmasks the harrowing division of domestic tasks and formal working hours between men and women and their respective inequality indexes. The present brings in its scope the discriminations foreseen in the legal text and proposes a re-reading of the norms with fulcrum in the constitutional principles and in the light of the human rights

Justificativa: Com base no histórico do trabalho da mulher e auxílio do direito comparado o presente traz em seu escopo algumas das dificuldades enfrentadas pelas mulheres no cotidiano familiar e laboral e tem por foco a conquista e efetivação da equidade nas relações de trabalho. Hipóteses: Ao longo dos anos a mulher tem encontrado diversas barreiras no mercado de trabalho tanto referentes à sua inserção como à sua ascensão. Questiona-se por qual motivo essa realidade se concretiza? Quais os fatores que cooperam com a dificuldade da mulher se inserir no mercado de trabalho? Aspectos teórico-metodológicos: Análise do Ordenamento Jurídico Brasileiro, do entendimento de doutrinadores do Direito Trabalhista, Jurisprudência e publicações acadêmicas. Resultados obtidos: Pesquisas sobre o trabalho da mulher refletem um cenário que desmascara a angustiante divisão de tarefas domésticas e de jornadas de trabalho formais entre homens e mulheres e seus respectivos índices de desigualdade.
