This research aims to bring up the matter of the risk increase in insurance contracts and the possible abuse of clauses that exempt insurer from the obligation to provide the insured with rules and principles of the Code of Consumer Protection and its regulation by the Civil Code, allied to the observance of the dictates recommended by the principles of objective good faith and social function. The forms of risk raise, if derived or not, due to insured's intentional or guilty conduct, change of the insured without the participation and / or contribution of the former insured will be addressed hereby, in addition to dealing specifically with the drunkenness of the driver as a hypothesis of loss of the insurance granted and its causal relation with the accident, as well as the extension of its effects to other drivers of the vehicle, other than the insured
