Resumo: The present research aims to introduce what is “Devida Diligência”, better known as Due Diligence and what is the objective, in general, that companies have when carrying it out. In addition, explain why a Due Diligence can be effective in identifying gaps in a company's system, whether medium or large, regarding the protection and guarantee of Human Rights. With the development of capitalism, the practice of outsourcing services is increasingly common, moving away from inspection control of labor guarantees, such as health, working hours, child labor, enslavement, equality, remuneration, among others. However, it is not possible for a company to exempt itself from liability for damages caused simply by claiming that they were not aware of the situation that caused or was causing damage. In this way, Due Diligence offers a labor guarantee not only to the employees of that company, but to the entire labor chain that its services encompass. Based on a theoretical review on the subject, an analysis of specific cases was carried out that confirmed the importance of Due Diligence, observing cases in which the diligence identified negative impacts on human rights

Ademais, explicar o porquê uma Due Diligence pode ser efetiva em identificar brechas no sistema de uma empresa, sendo esta de médio ou grande porte, no que tange à proteção e garantia de Direitos Humanos. Com o desenvolvimento do capitalismo, a prática da terceirização de serviços é cada vez mais corriqueira, afastando o controle de fiscalização de garantias trabalhistas, como salubridade, jornada de trabalho, trabalho infantil, escravização, igualdade, remuneração, entre outros. No entanto, não é possível que uma empresa se exima da responsabilidade dos danos causados simplesmente por alegarem que não tinham conhecimento da situação que causou ou que estava causando danos. Dessa forma, a Due Diligence oferece uma garantia trabalhista não somente aos colaboradores daquela empresa, mas sim à toda a cadeia trabalhista que seus serviços englobam.
