The Supply Chain Due Diligence Act (LKSG) in Brazil: an empirical analysis

Resumo: | This report presents the methodology and results of the research on theimpact of the German Due Diligence Law and how German companies and others subject to German jurisdiction operating in Brazil are adapting their policies and activities based on the legislation. The idea for the project started with previous work by Homa - Center forHuman Rights and Business - on regulatory frameworks for business and human rights, such as the in-depth study on the Treaty on Human Rights and Business, under negotiation at the UN Human Rights Council, and the National Action Plans (NAPs). This project was developed from the dialogue between Homa and theGerman Embassy in Brazil, with the purpose of understanding the German Law within the Brazilian scenario. In this research two objectives were established: i) to analyze the obligations contained in the "German Law on Monitoring ValueChains"; ii) how German companies, and others under German jurisdiction, which have activities in Brazil, are adapting to the new legal framework. |

O presente relatório apresenta a condução e resultados da pesquisa sobre o impacto da Lei Alemã de Devida Diligência e como as empresas alemãs e outras submetidas à jurisdição alemã atuantes no Brasil estão adaptando suas políticas e atividades com base na legislação. A ideia para o projeto tem início em trabalhos anteriores do Homa - Centrode Direitos Humanos e Empresas- sobre marcos regulatórios para empresas e direitos humanos, tais como o estudo aprofundado sobre o Instrumento juridicamente vinculante sobre Empresas e Direitos Humanos, em negociação no Conselho de Direitos Humanos da ONU, e os Planos Nacionais de Ação (PNA’s). Este projeto nasce do diálogo do Homa com a Embaixada da Alemanha no Brasil, com o propósito de entender a Lei Alemã dentro do cenário brasileiro.
