Resumo: Throughout the historical development of the Brazilian legal system, the legislator has created protective measures for women in order to promote their participation in the labor market. The CF / 88 and the Consolidation of Labor Laws ensure the reduction of the risks inherent to the worker's activity, through health, hygiene and safety rules. Thus, in the face of equality between men and women, with a focus on CF / 88, protection against any form of discrimination between employees was allowed. In the present study, some changes in the labor reform were flagrantly unconstitutional in the opinion of several professors, such as the possibility of the pregnant woman working in unhealthy places of medium or minimum degree, in which she disobeys the constitutional norms of maternity protection. In addition, it was the whole normative set that protects the activity of women within the scope of labor relations

A CF/88 e a Consolidação das Leis do Trabalho asseguram a diminuição dos riscos inerentes a atividade da trabalhadora, através de regras de saúde, higiene e segurança. Assim, diante da igualdade entre homens e mulheres, com fulcro na CF/88, permitiu-se a proteção contra qualquer forma de discriminação entre os empregados. No presente estudo abordou-se algumas mudanças advindas da reforma trabalhista, flagrantemente inconstitucionais na opinião de vários doutrinadores, como a possibilidade de a gestante trabalhar em lugares insalubres de grau médio ou mínimo, em que se desobedece às normas constitucionais de proteção à maternidade.
