Resumo: | The elitism that surrounds elementary education have increasingly been a mark of its historical trajectory, being known as the "Empire of the Middle" (DALLABRIDA E SOUZA, 2014). However, between 1930 and 1942, changes started to be made in order to expand and create new public elementary schools. This process involved the creation of vast educational legislation which modified governmental decisions and imposed rules that resulted in a change of societal behavior. The objective of this dissertation is to investigate the history of the elementary education in São Paulo between 1930 and 1942. First, it will be mapped the activities of federal entities (union, states and municipalities), highlighting the role of each of them in the elaboration and enactment of laws and decrees that contemplated secondary education. This dissertation also sought to investigate the impact of the federal entities' decisions on the actors involved and the interests and conflicts that surround the creations of new schools. This research was made through the analysis of files from the “Centro de Acervo Permanente do Arquivo Público do Estado de São Paulo”, in association with the legislation of the time available at the “acervo digital da Assembleia Legislativa de São Paulo". It was based on the concepts of law, justice and society (CAVALIERI FILHO, 2002) and the "reservation of the possible v. minimum existential" (COUTINHO, 2013). This research confirmed the initial hypothesis that there was an influence from executive power in the expansion of elementary schools, due to all of the new legislations associated with the creation of new schools but not because of cooperation between the powers. This range of laws or decrees involving municipal counterparts has become an obstacle to the completion of projects, considering the lack of resources of municipalities for investment in education. This scenario was aggravated due to the increasing demand for secondary education, in which the absence of vacancies or the economic shortage - and not the admission examination - proved to be the main obstacles to be overcome. No entanto, os anos de 1930 a 1942 consagraram-se um período ímpar na história desse nível de ensino, envolvendo reformas em âmbito estadual e municipal, que concorreram para a renovação e a consequente expansão dos ginásios estaduais. Esse processo envolveu a promulgação de uma vasta legislação educacional, que concorreu para decisões governamentais e impôs regras, modificando comportamentos e costumes. O objetivo deste trabalho consiste em investigar a trajetória histórica do ensino secundário no estado de São Paulo no referido período, primeiramente mapeando a atuação dos entes federativos (união, estados e municípios), destacando o papel de cada um deles frente à elaboração e promulgação de leis e decretos que contemplavam a educação secundária. Buscou-se também investigar o impacto das suas decisões frente aos sujeitos envolvidos e quais os interesses e conflitos que cingiram as criações dos estabelecimentos de ensino. As fontes utilizadas para a realização desse trabalho são documentos do Centro de Acervo Permanente do Arquivo Público do Estado de São Paulo, sobretudo remanescentes da Secretaria dos Negócios do Interior e Secretaria da Educação e a legislação educacional promulgada no período estudado, disponível no acervo digital da Assembleia Legislativa de São Paulo, tomando como base os conceitos de lei, justiça e sociedade (CAVALIERI FILHO, 2002) e reserva do possível v. mínimo existencial (COUTINHO, 2013). A pesquisa confirmou as hipóteses de que houve uma atuação forte principalmente do poder executivo estadual e municipal na criação dos ginásios estaduais, com grande quantidade de leis associadas à criação e administração das escolas, porém raramente em regime de colaboração. Essa gama de leis ou decretos envolvendo contrapartida municipal se configurou em um obstáculo para a conclusão de projetos, haja vista os parcos recursos de municípios para investimento em educação. Isso foi agravado devido a um contexto de demanda crescente pelo ensino secundário, no qual a ausência de vagas ou a carência econômica - e não o exame de admissão - se revelaram os principais obstáculos a serem superados.
