Resumo: The following study intended to analyze the innovations introduced by the Law nº 13.105 of 03.16.2015, regarding the evidences, the free conviction of the judge and especially the distribution of the burden of evidence in civil proceeding. Therefore it will be studied the introductory concepts that permeate the subject, through the origin of proofs, its conceptualization in civil proceedings, the object of the proof, the purpose of the proof, the addressee of the proof, the types of proof, to the distribution of the burden of proof, making a comparison between the old and the current Code of Civil Procedure. It will also be analyzed the informative principles of proof in civil proceeding, as well as the structural rules of the evidences, taking into account the constitutional profile of civil procedure. Developed based on doctrinal and jurisprudential research, this work is dedicated to the study of the magistrate's role as the manager of evidences, and finally before the innovations introduced by the new Civil Procedure Code, will be seek to show the modifications and the consequences brought about by the article 373, § 1, which deals with the theory of the dynamics distribution of the burden

Para tanto, serão estudadas as noções introdutórias que permeiam o tema, passando pela origem da prova, sua conceituação no processo civil, o objeto da prova, a finalidade da prova, o destinatário da prova, as provas em espécie, até chegar a distribuição do ônus da prova, fazendo-se um comparativo entre o antigo e o atual Código de Processo Civil. Será objeto de análise, também, os princípios informadores da prova no processo civil, bem como as normas estruturantes do direito probatório, levandose em conta o perfil constitucional do processo civil.
