Resumo: The present study sought to analyze the sudden change that the legal system and national jurisprudence suffered in regard of moral damages, after the Federal Constitution of 1988 and subsequent legislation. We analyze the tendency of part of the jurisprudence to arbitrate modest amounts as compensation for moral damages, inspired by certain criteria and common fears in the arbitration of the indemnity quantum, such as the impossibility of an “enrichment of the victim” and the so-called “moral damages industry”. Then, we discuss the compatibility of these arguments with the new constitutional order and what is the course that it establishes for the new institute of moral damages

Analisamos a tendência de parte da jurisprudência em arbitrar valores módicos a título de indenização por danos morais, inspirada em determinados critérios e receios frequentes no arbitramento do quantum indenizatório, como a impossibilidade de um “enriquecimento da vítima” com a indenização e a chamada “indústria dos danos morais”.
