This present paper has the objective of analyzing the changes implemented and consolidated by the Brazilian New Processual Civil Code with regard to judicial precedents. From the study of stare decisis doctrine and the mechanisms of identification, distinction and overcoming of judicial subject in it bounded such as ratio decidendi, obiter dictum, distinguishing, hard case, overruling e overriding we trace the influence of the precedent system originated from the Common Law in order to proceed in the study of the juridical consequences in perspective to a system which notably prioritize and value for integrity of the facts and stability of judicial decisions. After the study of the normative strength of the precedents in the Brazilian system, with focus on the changes introduced by the New Processual Civil Code, we analyze the mechanisms in order to overcome it and the effect of the decisions that break paradigms (limited retrospectivity, prospective overruling, pure prospectivity, etc.). Lastly, upon verification that the lack of uniformity and coherence in the judicial decisions in addition to the existence of a culture of respect to the judicial precedents in Brazil put in risk the principal of the juridical safety, we conclude for the necessity of maturation of this theme between the law operators in which without doubts contributed fundamentally with the New Processual Civil Code
