This academic work aims to analyze the pre-execution exception, a legal remedy inserted in our laws, after construction of doctrinal-jurisprudential. Despite not being an unprecedented issue, it has suffered a significant change with the enactment of Law 11.382/2006, even if this modification was implemented at a time when using the pre-execution exception as a procedural remedy had already been consolidated, that did not require the guarantee of judgment, in several hypotheses, and when misplaced. The absence of specific ruling for pre-execution exception was the "salvation" for the debtor, as used indiscriminately, without the need to use technical ways. The aforementioned lack of technic begins with confusion, and distinctions in the very nomenclature of the institute, 7 ranging from "exception of pre-execution", "objection of non-execution" and "pre-execution of objection." In this study were analyzed the chances of appropriateness, the deadline for its opposition, recurring procedural questions of its use, especially over decisions and resources, as well as on the effects of their procedures, particularly on the execution process
