Resumo: Through the perspective of the liberalism arose at the French Revolution, the men kind subjected the species to the threshold of degradation in the face of subhuman conditions of work. As the industrialization invaded the productive sector the workers were submitted to longer and exhausting working days. In view of these conditions, the proletariat formed the class consciousness, claiming for the need of the state to intervene on behalf of the weakest, mainly through standards which limited the duration of the working days. Thus, among the principles that protect the human work and dignify the worker, stands out the one referred to time of work limitation. The working hours is conceptualized at the article number 4 of the Labor Code as a period in which the employee has to be available to the employer, awaiting or executing orders, composing yet the time in intinere (58th article, 2nd paragraph, Labor Code). The working hours are composed by the maximum amount of time established to the duration of work as a result of the agreement, as well as the supplementary components, such as the duties that exceed the maximum of time established by the law. The Federal Constitution of 1988 devoted its 7th article, line XIII, to the rule concerning regular duration of work, which shall not be more than eight hours per day and forty-four hours per week, fraction of the day followed by the 58th article of the Labor Code. To the extraordinary working hours found as mere prorogation agreement, the 59th article of the Labor Code established that they shall not be of more than two daily hours. Therefore, the maximum working time tolerable by the Brazilian legislation is of ten hours a day. The High Posts are permanent derogations of the working hours, in which the employees hold the management positions, by literal determination of the 62th article, Line II of the Labor Code. The management post, in a different way from the position of trust (intermediary), is characterized by the accumulation of two requirements: a) objective: a wage distinction from the lower post of, at least, 40%, plus function bonus in certain cases; and b) subjective: performance of power of management, formed by Independence, collaboration, directive power performance and management of the company. Considering the Judiciary approval, which often applies the referred article as an excluding of high posts to the rules concerning the duration of work, the employers take advantage of this mechanism which, again, demand extreme long and exhausting working hours from the employees, because it does not exist any obligation on timing control, nor payment of overtime. This circumstance has been one of the new ways of precarious of the conditions of work, which violate the fundamental rights such as the dignity of the human being and those concerning the worker existence. Therefore, seeking to preserve the health and the life of salaried workers, the 62th article, line II of the Labor Code should be better interpreted, according to the hermeneutic methods. The idea of limitation of working hours to the employees who have a management post considers the historical/evolutionary and logical/systematic and observes the unequal situation of this employee before the others in order to attribute the amount of work time matching the maximum tolerable duration by the legislation, which is ten hours per day, reason why the remuneration distinction has the role of consideration of the two hours that exceed the eighth

Na medida em que a industrialização invadia o setor produtivo, os trabalhadores eram submetidos cada vez mais a jornadas de trabalho muito longas e exaustivas. Diante dessas condições, o proletariado formou a chamada consciência de classe, reivindicando a necessidade de intervenção do Estado para proteção dos mais fracos, principalmente por meio de normas a limitar a duração da jornada de trabalho. Assim, entre os princípios que se universalizaram visando à proteção do trabalho humano e a dignificação do trabalhador, destaca-se o referente à limitação do tempo de trabalho. A jornada de trabalho é expressamente conceituada no art. 4º, CLT, como o período em que o empregado esteja à disposição do empregador, aguardando ou executando ordens, compondo ainda o tempo in itinere (art. 58, §2º, CLT). A jornada de trabalho é composta pelo tronco básico, tempo máximo previsto para duração do trabalho decorrente do contrato, e pelos componentes suplementares, como o trabalho que extrapola o tempo normal. A Constituição Federal de 1988 consagrou no artigo 7º, inciso XIII, a regra referente à duração normal do trabalho, sendo não superior a oito horas diárias e quarenta e quatro semanais, fração do dia acompanhado pelo art. 58, caput, CLT. Para a jornada extraordinária na modalidade de mero acordo de prorrogação, o art. 59, caput, CLT, estabeleceu que não poderá ser superior a duas horas diárias. Tem-se, assim, o tempo máximo tolerável de trabalho pela legislação Brasileira de dez horas por dia. Como derrogações permanentes da jornada de trabalho estão os altos cargos, sendo os empregados ocupantes de cargo de gestão, por literal determinação contida no art. 62, II, CLT. O cargo de gestão, diferente do cargo de confiança (intermediário), é caracterizado pela acumulação de dois requisitos: a) objetivo: distinção remuneratória do cargo subalterno de, pelo menos, 40%, com gratificação de função, se houver; e b) subjetivo: exercício do poder de gestão, caracterizado pela independência; colaboração; exercício da parcela do poder diretivo e gestão da empresa. Diante do consentimento do Poder Judiciário, que aplica constantemente o referido artigo como excludente dos altos cargos às normas atinentes da Duração do Trabalho, aproveitam-se os empregadores desse mecanismo que, novamente, exige dos empregados o cumprimento de jornadas excessivamente longas e cansativas, porque não há obrigatoriedade de controle de horários, muito menos pagamento de horas extras. Essa circunstância tem sido uma das novas formas de precarização das condições de trabalho, com violação dos direitos fundamentais, como a dignidade da pessoa e aos pertinentes à existência do trabalhador. Destarte, em busca da prevenção da saúde e da vida do assalariado, deve ser feita melhor interpretação do art. 62, II, CLT, diante dos métodos hermenêuticos.
