This paper aimed at the analysis of Section 62, II, of the Brazilian Labor Code – “CLT”, which excludes the employees in charge of management position of the working hours system, set forth in Chapter II of the CLT. The requirements for the classification of the employee in management position must be analyzed case by case. In general, this employee must be excluded from the hours control, be in a position of trust, and perceive a value higher than 40 % of the amount perceived by other employees. The doctrine and case law, tends to appoint the constitutionality of the Article 62, II of the CLT, however this understanding is not peaceful considering it can infringe the limits of working hours that represents a fundamental precept stated by the Brazilian Federal Constitution. Even considering that the working hours control is not suitable to employee in a management position, these employees cannot be excluded from the working hours limits
