Resumo: The present work intend to discuss the provisional enforcement of penalty payment regarding advance relief, dealing, at first, with penalty payment separately and its concept, jointly with its juridical nature, as well as its limits, the beneficiary and the possibility of alteration of the fine after being set by the judge. It delineates general notions of the Provisional Enforcement, as well as the principles which rules it, its procedures and the recent provisional enforcement of extra juridical titles. It ascertains all the positions about the provisional enforcement of the penalty payment regarding advance relief, both the favorable and the unfavorable, besides the recent newsletter 511 of STJ.

Traça noções gerais da Execução Provisória, como os princípios que a norteiam, seu procedimento e a recente execução provisória de título extrajudicial.
