Resumo: This study pretends to present the legal regime of the utility easement in the Brazilian legal system. To this end, the main legal norms (constitutional and infra) on the matter were analyzed, as well as the doctrinal and jurisprudential interpretation of those legal norms. Through this analysis, the main points of the legal regime of the utility easement were identified, notably: their legal nature (real right about something unrelated), its purpose (to satisfy the most different purposes, since this purposes are provided with public interest), its object (goods movable or immovable, public or private), its content (obligations of support, to do and not to do), their modes of constitution (law, agreement or court order), and the State's duty to indemnity the damages arising from the establishment of the utility easement. Finally, from the identification of the main points of the legal regime of the utility easement, also were identified the main doctrinal and jurisprudential disagreements on matter, about which we always try to position ourselves

Para tanto, foram analisadas as principais normas jurídicas (constitucionais e infraconstitucionais) sobre a matéria, bem como a interpretação doutrinária e jurisprudencial dessas normas jurídicas. Por meio dessa análise, foram identificados os principais pontos do regime jurídico da servidão administrativa, notadamente: sua natureza jurídica (direito real sobre coisa alheia), sua finalidade (satisfazer os mais diferentes fins, desde que de interesse público), seu objeto (bens móveis ou imóveis, públicos ou privados), seu conteúdo (obrigações de suportar, não fazer e fazer), seus modos de constituição (lei, acordo ou decisão judicial) e de extinção (lei, desafetação, perecimento ou transformação da coisa serviente e confusão), e o dever do Estado de indenizar os danos decorrentes da constituição da servidão administrativa.
